Acceptable Use Policy
Effective Date: March 1, 2026
This Acceptable Use Policy (“AUP”) describes the rules governing your use of the MyPHI mobile application and Platform (the “Platform”) operated by MyPHI, Inc. (“MyPHI”). This AUP is incorporated by reference into the MyPHI Terms of Service. By using the Platform, you agree to comply with this AUP. Capitalized terms not defined here have the meanings given in the Terms of Service.
1. Permitted Uses
The Platform is designed and intended for the following personal, lawful purposes:
- Recording your own medical appointments with consenting healthcare providers
- Recording medical appointments of your minor child or adult dependent for whom you are the legal guardian or authorized representative, with provider consent
- Generating and reviewing AI-produced summaries and action items from your medical visits
- Sharing visit summaries with family members or caregivers you trust through the Care Circle feature
- Asking follow-up questions to better understand your healthcare visit
- Managing and organizing your personal health visit comprehension
2. Recording — Prohibited Uses
You may NOT use the recording features of the Platform to:
- Record any conversation without complying with applicable one-party or all-party state recording consent laws
- Record a healthcare provider who has explicitly declined consent to be recorded
- Record conversations in jurisdictions where you have not obtained all legally required consents
- Record conversations for the purpose of litigation, evidentiary use, investigation, or surveillance without proper legal authority
- Record individuals other than your healthcare providers, your minor children's providers, or providers for dependents for whom you have legal authority
- Record emergency medical personnel, mental health crisis counselors, or any person in a professional capacity who has not consented
- Record any conversation where the purpose is to embarrass, harass, or harm another person
3. Health Information — Prohibited Uses
You may NOT use the Platform to:
- Create, store, or share fabricated or misleading medical information
- Use AI-generated summaries as a substitute for professional medical advice in any clinical, emergency, or high-stakes medical decision
- Share another person's health information without their explicit authorization
- Share visit summaries with individuals who are not legitimately part of your care support network
- Use the Platform to record health information about individuals other than yourself or those for whom you have legal authority
4. Account and Platform — Prohibited Uses
You may NOT:
- Create more than one account per individual
- Share your account credentials or grant access to your account to any other person
- Create accounts on behalf of other individuals without their express authorization
- Impersonate any person or entity
- Misrepresent your identity, age, location, or authority when creating an account or using the Platform
- Use the Platform if you are under 18 years of age
- Use the Platform if you are located outside the United States
5. Technical — Prohibited Uses
You may NOT:
- Attempt to reverse-engineer, decompile, disassemble, or tamper with any part of the Platform or its underlying technology
- Attempt to gain unauthorized access to the Platform's systems, servers, or databases
- Attempt to access the data of any other user
- Upload, transmit, or introduce any viruses, malware, or other malicious code
- Use automated means (bots, scrapers, scripts) to access or interact with the Platform
- Interfere with or disrupt the integrity or performance of the Platform
- Bypass or circumvent any security measure or access control
6. Commercial — Prohibited Uses
You may NOT:
- Use the Platform for any commercial purpose without MyPHI's prior written consent
- Resell, sublicense, or otherwise make the Platform available to third parties
- Use the Platform to develop or train competing products or services
- Use the Platform to provide medical transcription or summary services to others
7. Consequences of Violations
MyPHI reserves the right to:
- Immediately suspend or terminate your account upon violation of this AUP
- Preserve and disclose your information to law enforcement or other authorities where required by law or where we reasonably believe a crime has been committed
- Pursue all available legal remedies for AUP violations
We may, but are not obligated to, provide you with notice and an opportunity to cure a violation before taking action. Serious violations, particularly those involving illegal recording or misuse of health information, may result in immediate termination without notice.
8. Reporting Violations
If you become aware of any violation of this AUP by another user or by MyPHI, please report it to us at legal@myphi.com. We take all reports seriously and will investigate promptly.
9. Changes to This Policy
MyPHI may update this AUP from time to time. Material changes will be communicated via in-app notification or email. Continued use of the Platform after changes are posted constitutes acceptance of the revised AUP.
