4. Minors and Dependent Users

While the Website itself is restricted to users 18 and older, the MyPHI Platform (mobile application) may be used by an adult parent or legal guardian to manage health visit recordings on behalf of a minor child or dependent individual. If you access this Website as part of managing health information for a minor or dependent:

• You represent that you are the parent or legal guardian of the minor or the authorized legal representative of the dependent
• You accept these Terms on behalf of yourself and confirm your legal authority to do so
• Additional provisions applicable to pediatric and dependent recordings are described in the Platform Terms of Service

5. Permitted Use

The Website is for informational and marketing purposes. You may use the Website to learn about MyPHI's services, download the App, access support resources, and contact MyPHI. You agree not to:

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings conducted in Wilmington, Delaware. Either party may seek injunctive relief in a court of competent jurisdiction in New Castle County, Delaware for intellectual property matters.

Class Action Waiver: To the extent permitted by law, you waive any right to bring or participate in a class action lawsuit or class-wide arbitration with respect to your use of MyPHI Platform.
