MyPHI, Inc. (“MyPHI,” “we,” “our,” or “us”) operates the Website. Our platform helps users record, understand, and manage their healthcare appointments. We are incorporated in the State of Delaware and operate the Website from the United States. The Platform is available only to users located in the United States.
3. Eligibility
You must be at least 18 years of age to use this Website. By using the Website, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. The Website is available to residents of the United States only.
4. Minors and Dependent Users
While the Website itself is restricted to users 18 and older, the MyPHI Platform (mobile application) may be used by an adult parent or legal guardian to manage health visit recordings on behalf of a minor child or dependent individual. If you access this Website as part of managing health information for a minor or dependent:
- You represent that you are the parent or legal guardian of the minor or the authorized legal representative of the dependent
- You accept these Terms on behalf of yourself and confirm your legal authority to do so
- Additional provisions applicable to pediatric and dependent recordings are described in the Platform Terms of Service
5. Permitted Use
The Website is for informational and marketing purposes. You may use the Website to learn about MyPHI's services, download the App, access support resources, and contact MyPHI. You agree not to:
- Use the Website for any unlawful purpose
- Attempt unauthorized access to the Website or related systems
- Engage in data scraping or automated data collection without prior written consent
- Transmit malicious code or interfere with Website operations
- Frame or mirror any portion of the Website without written consent

14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with proceedings conducted in Wilmington, Delaware. Either party may seek injunctive relief in a court of competent jurisdiction in New Castle County, Delaware for intellectual property matters.
Class Action Waiver: To the extent permitted by law, you waive any right to bring or participate in a class action lawsuit or class-wide arbitration with respect to your use of MyPHI Platform.
15. Changes to These Terms
MyPHI reserves the right to modify these Terms at any time. Material changes will be noted by a revised effective date posted on the Website. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
